Refund policy

One rule for everyone, written down. Business customers can request a refund within 24 hours of purchase if little of the plan has been used; consumers keep their statutory 14-day right of withdrawal, which this policy never limits. Failed requests are never charged.

This Refund Policy applies to Datafuel Services supplied by Double C S.r.l. It is part of the Terms of Service. Mandatory consumer rights always prevail.

1. Business Customers

A Business Customer may request a refund within 24 hours of purchase if:

  • no more than 5% of a Scraping API plan has been used; or
  • no more than 500 MB of a GB-based Consumption Product has been used.

If either applicable usage limit is exceeded, the purchase is non-refundable unless Datafuel agrees otherwise in writing or mandatory law requires a refund.

Payments made through CoinGate cryptocurrency and Payssion local payment methods are non-refundable under this Business Customer refund regime.

A Business Customer may request a refund by emailing support@datafuel.ai with the Order ID, Account email, purchased product, payment date, and reason for the request.

Datafuel reviews a complete request and normally processes an approved refund within 10 business days. The payment provider may require additional time before the funds appear in the Customer’s account.

Refunds are made to the original payment method where that method can receive refunds. Datafuel may instead provide account credit where the Business Customer requests it or where the original payment route cannot receive a refund and the Business Customer agrees.

2. Consumers

The statutory 14-day right of withdrawal applies to Consumers buying online. It is not limited by the 24-hour, 5%, or 500 MB Business Customer rule.

Datafuel begins performance during the withdrawal period only where the Consumer expressly requests immediate performance at checkout through the separate checkbox and acknowledges the statutory consequences.

If the Consumer withdraws after performance has begun but before the Service is fully performed, Datafuel may charge only a proportionate amount for what was supplied up to the time the withdrawal notice is received.

Once a Service has been fully performed, the Consumer loses the right of withdrawal where the statutory conditions are met, including the prior express request and acknowledgement.

The Consumer should use the Datafuel Consumer Pre-contractual Information and Right of Withdrawal Notice, including its model form, or send a clear withdrawal statement to legal@datafuel.ai.

Datafuel refunds amounts due within 14 days after receiving the withdrawal notice, using the same payment method used for the original transaction unless the Consumer expressly agrees to another method without cost.

If the payment method cannot receive a refund, including certain cryptocurrency transactions, Datafuel refunds by bank transfer or another equivalent method agreed with the Consumer.

The Business Customer rules and the non-refundable treatment of cryptocurrency and local payment methods do not limit a Consumer’s statutory withdrawal rights, legal guarantees for digital Services, or other mandatory remedies.

3. Common rules

A failed request is never charged under the applicable successful-request billing rule. A correction for a failed request is therefore not a refund.

SLA service credits are governed by the SLA and its claim procedure. They are not governed by this Policy unless the SLA expressly refers to this Policy.

Dedicated Products, including static ISP, Datacenter, and Mobile products, are normally non-refundable once the dedicated period has begun, subject to the statutory Consumer withdrawal regime and any mandatory legal remedy.

Trials are provided under the applicable trial offer. Datafuel does not promise a cash refund for unused or expired trial credits or trial access.

Datafuel may deny or reverse a refund where the request involves fraud, abuse, unlawful use, duplicate trial use, payment fraud, chargeback abuse, or a breach of the AUP. This does not limit mandatory Consumer rights.

1. Clienti Business

Un Cliente Business può chiedere un rimborso entro 24 ore dall’acquisto se:

  • è stato utilizzato non più del 5% di un piano Scraping API; oppure
  • sono stati utilizzati non più di 500 MB di un Prodotto a consumo fatturato in GB.

Se il limite di utilizzo applicabile è superato, l’acquisto non è rimborsabile, salvo diverso accordo scritto con Datafuel o salvo che un rimborso sia imposto dalla legge.

I pagamenti effettuati tramite criptovaluta CoinGate e tramite metodi di pagamento locali Payssion non sono rimborsabili secondo il regime applicabile ai Clienti Business.

Il Cliente Business può chiedere il rimborso scrivendo a support@datafuel.ai e indicando ID dell’Ordine, email dell’Account, prodotto acquistato, data del pagamento e motivo della richiesta.

Datafuel esamina una richiesta completa e normalmente esegue il rimborso approvato entro 10 giorni lavorativi. Il prestatore di pagamento può impiegare ulteriore tempo per rendere disponibili le somme.

Il rimborso viene effettuato sul metodo di pagamento originario quando tale metodo può ricevere rimborsi. Datafuel può invece riconoscere un credito sull’Account se il Cliente Business lo richiede oppure se il metodo originario non può ricevere il rimborso e il Cliente Business accetta.

2. Consumatori

Ai Consumatori che acquistano online si applica il diritto legale di recesso di 14 giorni. Tale diritto non è limitato dalla regola di 24 ore, 5% o 500 MB prevista per i Clienti Business.

Datafuel inizia l’esecuzione durante il periodo di recesso solo se il Consumatore richiede espressamente l’esecuzione immediata al checkout mediante la casella separata e riconosce le conseguenze previste dalla legge.

Se il Consumatore recede dopo l’inizio dell’esecuzione ma prima della completa esecuzione del Servizio, Datafuel può addebitare soltanto un importo proporzionale a quanto fornito fino al momento in cui riceve la comunicazione di recesso.

Dopo la completa esecuzione del Servizio, il Consumatore perde il diritto di recesso quando ricorrono le condizioni previste dalla legge, inclusi la richiesta espressa e il riconoscimento preventivi.

Il Consumatore dovrebbe utilizzare l’Informativa precontrattuale e il Recesso Datafuel per i consumatori, incluso il modulo tipo, oppure inviare una dichiarazione chiara di recesso a legal@datafuel.ai.

Datafuel rimborsa le somme dovute entro 14 giorni dalla ricezione della comunicazione di recesso, utilizzando lo stesso mezzo di pagamento impiegato per la transazione originaria, salvo che il Consumatore accetti espressamente un mezzo diverso senza sostenere costi.

Se il metodo di pagamento non può ricevere un rimborso, incluse alcune transazioni in criptovaluta, Datafuel rimborsa tramite bonifico bancario o altro metodo equivalente concordato con il Consumatore.

Le regole per i Clienti Business e il trattamento non rimborsabile dei pagamenti in criptovaluta e dei metodi locali non limitano il diritto legale di recesso del Consumatore, le garanzie legali relative ai Servizi digitali o gli altri rimedi inderogabili.

3. Regole comuni

Una richiesta fallita non viene mai addebitata secondo la regola di fatturazione delle richieste riuscite. La rettifica relativa a una richiesta fallita non costituisce quindi un rimborso.

I crediti di servizio previsti dallo SLA sono disciplinati dallo SLA e dalla relativa procedura di richiesta. Non sono disciplinati da questa Policy, salvo espresso rinvio dello SLA.

I Prodotti Dedicati, inclusi i prodotti static ISP, Datacenter e Mobile, normalmente non sono rimborsabili dopo l’inizio del periodo dedicato, fatti salvi il regime legale di recesso dei Consumatori e gli eventuali rimedi inderogabili.

Le prove gratuite sono fornite secondo l’offerta di prova applicabile. Datafuel non garantisce un rimborso in denaro per crediti o accessi di prova non utilizzati o scaduti.

Datafuel può negare o revocare un rimborso in caso di frode, abuso, uso illecito, uso duplicato della prova, frode nei pagamenti, abuso della procedura di chargeback o violazione dell’AUP. Ciò non limita i diritti inderogabili dei Consumatori.

4. Versione per le pagine prodotto

Le richieste fallite sono gratuite. Rimborso entro 24 ore dall’acquisto per i piani non utilizzati; i consumatori conservano il diritto legale di recesso di 14 giorni.
